Data processing terms for businesses

These terms apply when a business uses AskBell to collect answers from other people. They form part of our Terms of use. Here, "you" means the business.

Who is who

• You are the Data Fiduciary (the "controller", in the words of other laws) for the answers your forms collect. You decide what to ask, why, and what happens to the answers.
• Newtact Lab Private Limited (OPC), which runs AskBell, is your Data Processor. We process those answers only to run AskBell for you.

These terms cover respondents' answers and whatever their form links carry. Your own account details are covered by our Privacy policy.

What we do

1. Act on your instructions. We process answers only as you direct through AskBell — collecting, storing, showing, exporting, sending them to the integrations you set up (your webhooks, API keys, Slack or Google Sheets), and deleting them — or as the law requires. We send answers only to the destinations you configure. We never sell them, and never send them to advertising or analytics companies.
2. Keep them confidential. Only named staff who need it for their work can reach production systems, and they must keep what they see confidential.
3. Use only listed sub-processors. The companies that help us are on the Sub-processors page. We update it before adding a new one, and will email you first if you ask.
4. Help with respondents' requests. If a respondent asks to see, correct or erase their answers, we help you do it. If they write to us, we pass the request on to you.
5. Keep answers safe, as described on our Security page.
6. Tell you about a breach. If a personal data breach affects your answers, we tell you without undue delay, with what we know, and help you meet your own duties under the law.

Deletion

• When you delete a form, it and its answers are kept for 30 days, so a mistake can be undone, and then erased.
• Backups roll off within a further 30 days.

Where data is kept

Answers are stored with Cloudflare, in its Asia-Pacific region where possible.

Your part

You are responsible for having a lawful reason for what you ask, for telling respondents what you collect and why (our Notice for respondents helps), and for answering their requests.

We answer every message to that address. If you are writing about your own data — to see it, correct it, or have it erased — say so in the subject line and we will treat it as a formal request under the Digital Personal Data Protection Act, 2023.
